By accessing or using the Site, you (“User,” “you,” or “your”) agree to be bound by these Terms and our Privacy Policy and Return & Refund Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.

• “Product(s)”: Refers to any physical items (e.g., canvas prints, posters, apparel, home decor) offered for sale on the Site.
• “Print-on-Demand (POD) Provider(s)”: Refers to the third-party manufacturing and fulfillment companies responsible for producing, packaging, and shipping the Products.

2. Acceptance of Terms

By accessing, browsing, or using any part of the Site, you signify your unreserved acceptance of these Terms, as they may be amended from time to time. These Terms constitute a legally binding agreement between you and Ceren McKay.

3. Changes to Terms

Ceren McKay reserves the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.

5. User Eligibility

The Site is intended for users who are at least 18 years of age. By using the Site, you represent and warrant that you are of legal age to form a binding contract with Ceren McKay. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

6. Account Creation (Optional)

If the Site allows for account registration:

• You may be required to create an account to access certain features or make purchases.
• You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Ceren McKay immediately of any unauthorized use of your account.
• Ceren McKay reserves the right to suspend or terminate your account and refuse any and all current or future use of the Site for any reason, including, without limitation, if we suspect that you have provided inaccurate, incomplete, or fraudulent information.

7. Product Information, Pricing, and Availability

• Product Descriptions: We strive to ensure that all Product descriptions, images, and specifications are as accurate as possible. However, we do not warrant that Product descriptions or other content of the Site are accurate, complete, reliable, current, or error-free.
• Color Representation: Please note that minor variations in color may occur between the on-screen representation of Products and their physical appearance. This is due to differences in monitor settings, display calibrations, lighting conditions during photography, and the inherent variations in the print-on-demand manufacturing process. Such minor variations are not considered manufacturing defects.
• Pricing: All prices displayed on the Site are in the currency specified and are subject to change without notice. While we strive for accuracy, in the event a Product is listed at an incorrect price due to a typographical error or error in pricing information received from our POD Providers, we shall have the right to refuse or cancel any orders placed for the Product listed at the incorrect price, regardless of whether the order has been confirmed and your payment method charged. If your payment method has already been charged for the purchase and your order is cancelled, we will issue a refund in the amount of the incorrect price.
• Availability: All Products are subject to availability. We reserve the right to discontinue any Product at any time.

8. Order Acceptance and Payment

• Order Placement: When you place an order through the Site, you are making an offer to purchase the Product(s) subject to these Terms.
• Order Confirmation: Upon receiving your order, we will send you an order confirmation email. This email constitutes acknowledgment of your order but does not signify our acceptance of your offer. Acceptance occurs when your payment is successfully processed and the order is sent to our POD Provider for fulfillment.
• Payment: All payments must be made in full at the time of purchase. We use secure third-party payment processors (e.g., Stripe, PayPal) to handle all transactions. Your payment information is securely transmitted directly to these processors and is not stored on our servers.
• Right to Refuse/Cancel: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing and/or shipping address.

9. Shipping and Delivery

• Print-on-Demand Fulfillment: All Products are produced, fulfilled, and shipped by third-party Print-on-Demand (POD) Providers. Ceren McKay acts solely as the facilitator connecting customers with these POD Providers.
• Shipping Times: Estimated shipping times are provided for informational purposes only and are not guaranteed. Actual delivery times may vary due to factors beyond our control, including but not limited to POD Provider processing times, carrier delays, customs procedures, and adverse weather conditions.
• Shipping Costs: Shipping costs will be calculated and displayed at checkout. These costs are determined by the POD Provider, product weight, dimensions, and destination.
• Risk of Loss: The risk of loss and title for all Products purchased from the Site pass to you upon our delivery of the Products to the POD Provider and the common carrier. Ceren McKay is not responsible for any Products lost, stolen, or damaged after they have been picked up by the common carrier. Any claims for lost or damaged items during transit must be filed directly with the shipping carrier or, in accordance with our Return & Refund Policy (Section 3), coordinated through us with the POD Provider.
• Incorrect Address: It is your sole responsibility to provide an accurate and complete shipping address. We are not responsible for delays, non-delivery, or additional costs incurred due to incorrect or incomplete shipping information provided by you.

10. International Orders, Customs, and Import Duties

• Buyer’s Responsibility: For all international orders (i.e., orders shipped to destinations outside of the country where the Product is manufactured/shipped from by our POD Provider), the recipient is solely responsible for any and all import duties, customs fees, tariffs, value-added taxes (VAT), goods and services taxes (GST), or other local taxes and charges levied by the destination country’s customs authorities.
• Exclusion from Price: These charges are not included in the Product price or the shipping cost displayed on cerenmckay.com at the time of purchase. Ceren McKay has no control over these fees, nor can we predict their exact amount, as they are determined by the destination country’s regulations and thresholds.
• Compliance: You are responsible for ensuring that any Products you order comply with import laws and regulations of your country of destination.
• Refused Delivery: If an international package is refused by the recipient due to the non-payment of customs duties, taxes, or fees, or if the recipient fails to retrieve the package from customs within the specified timeframe, the package may be returned to our POD Provider. In such cases, any refund issued will be for the Product price only, minus the original shipping cost, any return shipping fees incurred by our POD Provider, and any customs charges applied during the return process. Original shipping fees are strictly non-refundable for packages returned due to unpaid customs charges.

11. Intellectual Property Rights

• Ownership of Content: All designs, artworks, illustrations, paintings, graphics, text, images, videos, audio, and any other creative content (“Content”) displayed or available on cerenmckay.com, including all Products offered for sale, are the exclusive intellectual property of Ceren McKay. This Content is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
• Copyright Statement: All rights are reserved. The name “Ceren McKay” and all associated designs, artworks, and original creations are the sole and exclusive property of Ceren McKay.
• Prohibited Use: No part of the Site or any Content, including specifically any designs, artworks, illustrations, or paintings, may be reproduced, copied, adapted, modified, distributed, transmitted, displayed, performed, published, licensed, sold, or used in any form or by any means, whether electronic, mechanical, photocopying, recording, or otherwise, for any commercial purpose or public display, without the express prior written permission of Ceren McKay. This prohibition includes, but is not limited to, the creation of derivative works, commercial exploitation, or incorporation into other products or services.
